3. Cookies. Definitions, characteristics and application of the law.
Cookies are small text files that websites visited by the user send and record on the user’s computer or mobile device, to be then retransmitted to the same sites on the next visit. Thanks to cookies, a site remembers user actions and preferences so that they do not have to be re-indicated when the user returns to visit that site or navigates from one page to another. Cookies are therefore used to perform computer authentications, session monitoring and storage of information regarding the activities of users accessing a site and may also contain a unique identification code that allows tracking the user’s navigation within the site for statistical or advertising purposes. During navigation on a site, the user may also receive cookies from sites or web servers other than the one they are visiting (so-called “third-party cookies”) on their computer or mobile device. Some operations could not be performed without the use of cookies, which in certain cases are therefore technically necessary for the very functioning of the site. There are various types of cookies, depending on their characteristics and functions, and these can remain on the user’s computer or mobile device for different periods of time. We can distinguish them into:
– session cookies, which are automatically deleted when the browser is closed;
– persistent cookies, which remain on the user’s equipment until a predetermined expiration.
Based on current Italian legislation, explicit user consent is not always required for the use of cookies. In particular, “technical cookies” do not require such consent, i.e., those used solely for the purpose of transmitting a communication over an electronic communication network, or to the extent strictly necessary to provide a service explicitly requested by the user. These are, in other words, cookies essential for the functioning of the site or necessary to perform activities requested by the user. Among the technical cookies, which do not require explicit consent for their use, the Italian Data Protection Authority (cf. Provision Identifying simplified procedures for information and acquisition of consent for the use of cookies of 8 May 2014, hereinafter only “Provision”) also includes:
– analytics cookies when used directly by the site operator to collect information, in aggregate form, on the number of users and how they visit the site
– navigation or session cookies (for authentication)
– functional cookies, which allow the user to navigate based on a series of selected criteria (for example, language, products selected for purchase) in order to improve the service provided.
For “profiling cookies”, on the other hand, i.e., those aimed at creating user profiles and used to send advertising messages in line with the preferences expressed by the user while Browse the web, prior user consent is required.
Types of cookies used by Infogestione’s owned sites. Infogestione’s sites use the following cookies that can be deselected, except for third-party cookies for which direct reference must be made to the respective selection and deselection methods of their cookies, indicated below through hyperlinks (links):
– Technical/navigation or session cookies, strictly necessary for the functioning of the Site or to allow the user to use the contents and services requested.
– Analytics cookies, which allow to understand how the Site is used by users. These cookies do not collect information about the user’s identity, nor any personal data. The information is processed in aggregate and anonymous form.
– Functionality cookies, i.e., used to enable specific functionalities of the Site and a series of selected criteria (for example, language, products selected for purchase) in order to improve the service provided.
Third-party cookies, i.e., cookies from sites or web servers other than Infogestione’s used for their own purposes by these third parties, including profiling cookies. It is specified that these third parties, listed below with their respective links to privacy policies, are autonomous data controllers of the data collected through the cookies served by them; therefore, reference must be made to their personal data processing policies, information notices, and consent forms (selection and deselection of the respective cookies), as specified in the aforementioned Provision. As for third parties that send cookies through Infogestione’s sites, the hyperlinks (links) to their respective information notices are provided below: to these third parties, as already specified, the responsibility for providing the information and collecting user consent, as provided by the Provision, is delegated. This responsibility refers not only to the cookies that third parties send directly, but also to any further cookies that are sent through our Site by virtue of the use of services that the third parties themselves use. With respect to these cookies, in fact, sent by service providers of the aforementioned third parties, Infogestione has no possibility to exercise any control and knows neither their characteristics nor their purposes.
